This Clarification Text has been prepared by Bioeksen Ar Ge Teknolojileri Anonim Şirketi (“Bioeksen” or “Company”) in order to fulfill its clarification obligation to inform under Article 10 of the Personal Data Protection Law No. 6698 (“KVKK”) regarding the processing of users’ personal data during the use of the free Wi-Fi network.

2. Processed Personal Data, Purpose of Processing and Legal Basis

1. During the provision of internet access services, your name and surname are processed for the purposes of carrying out supervisory activities and identifying the individual accessing the Wi-Fi network.

2. During the provision of internet access services, your IP address is processed for the purposes of carrying out supervisory activities and, in particular, fulfilling the obligations arising from Law No. 5651.

 

Your identity data (name, surname) will be processed for the purposes of ensuring information security, providing information to authorized persons, institutions and organizations, and conducting activities in compliance with applicable legislation, based on the following legal grounds: provided that it does not harm the fundamental rights and freedoms of the data subject, processing is necessary for the legitimate interests of the data controller; processing is necessary for the establishment, exercise or protection of a right; and processing is necessary for the data controller to fulfill its legal obligations.

 

Your transaction security data (IP address) will be processed for the purposes of ensuring information security, providing information to authorized persons, institutions and organizations, and conducting activities in compliance with applicable legislation, based on the following legal grounds: being explicitly stipulated by law; provided that it does not harm the fundamental rights and freedoms of the data subject, processing is necessary for the legitimate interests of the data controller; processing is necessary for the establishment, exercise or protection of a right; and processing is necessary for the data controller to fulfill its legal obligations.

 

3. Purpose of Transfer of Personal Data and Recipient Groups

 

Your identity data (name, surname) and transaction security data (IP address), among the personal data listed above, may be shared with authorized persons, institutions, and organizations, including competent public authorities, where necessary for the data controller to fulfill its legal obligations, for the purpose of providing information to such authorities.
 

4. Method of Collection of Personal Data

Personal data may be collected electronically through log records and similar channels.

 

5. Your Rights under the KVKK

With respect to your personal data processed by us, you may submit your requests within the scope of Article 11 of the KVKK, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, at any time in writing or via your registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the electronic mail address previously notified to us and registered in our systems, to the addresses set out below:

If the transaction requires an additional cost, a fee may be charged in accordance with the tariff determined by the Personal Data Protection Board. Your requests will be finalized as soon as possible and no later than thirty days depending on the nature of the request.
